The new edition of the BVZ Tax Newsletter brings together relevant updates on the implementation of the Tax Reform, new tax compliance measures, and recent decisions involving tax settlements, ITCMD, IPTU, statute of limitations for tax credits, and taxation under the presumed profit regime.

Check out the highlights of this edition:

Tax Reform
– The Brazilian Federal Revenue Service and the IBS Management Committee regulate the National Tax Compliance Program, aimed at adapting taxpayers to the new obligations related to IBS and CBS.
– CGIBS and the Brazilian Federal Revenue Service publish adjustments to the event layouts and XSD files of the Declaration of Specific Regimes (DeRE).

Tax Settlement
– TJ-GO orders the suspension of the enforceability of a tax credit due to the municipal Administration’s delay in analyzing a tax settlement proposal.

Tax Updates
– SEFAZ-SP establishes that the tax basis for ITCMD on the donation of equity interests must reflect market value, rather than merely book value.
– The STF rules that municipalities may not set IPTU rates based on the area of the property.
– The Federal Court holds that collection notices and letters from the Brazilian Federal Revenue Service do not interrupt the statute of limitations for tax credits.
– TRF-3, in preliminary decisions, rejects the 10% increase in the presumed profit margin for companies subject to the presumed profit regime.
