The decline in judicial reorganisation filings in the agribusiness sector does not necessarily indicate an improvement in the sector’s financial situation.

According to data from Serasa Experian, judicial reorganisation filings fell by 20.7% in the second quarter of 2026 compared with the same period in the previous year. Despite this decrease, high levels of debt, production costs and difficulties in accessing credit continue to put pressure on producers and companies.

The situation was analysed by LexLegal Brasil in a report featuring comments from our partner Fábio Percegoni de Andrade, a specialist in Insolvency and Restructuring. He noted that judicial reorganisation is no longer regarded as an automatic solution to financial difficulties, requiring a careful assessment of its effectiveness in light of the specific characteristics of the sector.

Percegoni also discussed alternatives for renegotiation, such as rescheduling payment deadlines, reviewing charges and disposing of assets that are not essential to business operations, taking into account the circumstances of each transaction.

This scenario highlights the importance of anticipating risks and structuring solutions that reconcile the restructuring of liabilities with the continuity of business operations.
