
In this edition of the BVZ Tax Newsletter, we bring together relevant updates on the implementation of the Tax Reform and recent decisions involving ITBI, PIS/Cofins, CPRB and the offsetting of tax credits.

Tax Reform
– Companies under the Simples Nacional regime have until September 30 to choose the IBS and CBS collection model for 2027.
– The IBS Management Committee publishes calls for proposals for the development of systems focused on registration data, tax documents and the reimbursement of credit balances.
– The Brazilian Federal Revenue Service releases new technical documentation for the CBS calculation APIs, with gradual implementation starting in October.
– Cooperatives may opt for the specific IBS and CBS regime until October 31, effective as of January 2027.
Tax Updates
– The STF has five votes in favor of ITBI immunity on the contribution of capital to legal entities engaged in real estate activities.
– The Brazilian Federal Revenue Service opens a period for the regularisation of PIS/Pasep and Cofins credits identified as inconsistent.
– The STJ maintains the levy of PIS/Cofins on Selic interest from mandatory deposits.
– The STJ rules that CPRB is included in the PIS and Cofins tax base.
– The STJ rules that ICMS-Difal is excluded from the PIS and Cofins tax base.
– The STF upholds a monthly limit for the offsetting of tax credits recognised by court decisions.
