
In this edition of the BVZ Tax Newsletter, we have compiled updates on the implementation of the Tax Reform, new tax settlement rules and recent decisions on tax matters.

Tax Reform
– The Brazilian Federal Revenue Service will begin, on 15 October, integration testing of PSPs with the Public Split Payment Platform.
– The CGSN extends deadlines for opting for the Simples Nacional and the regular IBS and CBS regimes.
– Municipalities may now anticipate the migration of companies under the Simples Nacional to the National NFS-e system.
– The CNM projects the impact of IBS on municipal revenues through 2078 and classifies municipalities according to the estimates.
Tax Settlement
– The Tax Settlement Programme of Ribeirão Pires closes the enrolment period for debts registered as outstanding tax liabilities.
– The Government launches debt renegotiation programmes for MEIs, rural producers, employers and former scholarship holders.
– Natal establishes a permanent settlement policy for the recovery of tax and non-tax receivables.
Tax Updates
– The Brazilian Federal Revenue Service distinguishes the taxation of presumed ICMS tax credits under the cumulative and non-cumulative regimes.
– CARF upholds a decision ruling out the treatment of real estate investment funds (FIIs) as legal entities for IRPJ and CSLL purposes.
– CARF rules that an opinion issued by an MCTI-affiliated body does not overturn an unfavourable ministerial decision concerning projects under the Lei do Bem.
– The Federal Court of São Paulo rules out the 10% withholding of income tax on dividends distributed by a company under the Simples Nacional.
– A bill proposes raising the monthly income tax exemption threshold for stock market transactions to BRL 60,000 and extending the rule to other assets.
– CARF rules that an agribusiness company may not segregate its activities to determine the calculation basis for social security contributions.
